Marketplace Terms of Use and User Agreement. Please read carefully before using the Platform or making a Booking.
Key terms used throughout: "Booking" — a confirmed reservation for a Pod creating a binding contract between the User and the Pod Organiser (not MyDivePod). "Deposit" — an amount paid by a User to secure a Booking, held in trust. "Pod" — a dive trip organised and listed on the Platform by a Pod Organiser. "Pod Organiser" — an independent third party who lists Pods; not an agent of MyDivePod. "Platform" — the MyDivePod marketplace at www.mydivepod.com and related applications. "User" — any individual who accesses the Platform, creates an account, or makes a Booking.
MyDivePod operates as a marketplace connecting independent Pod Organisers with Users. MyDivePod acts as a facilitator only and does not operate or supervise any Pods; employ or control Pod Organisers, Guides, or crew; own or control Vessels or equipment; verify or endorse any Pod Organiser, Guide, Boat, or Dive Site; provide refunds or insurance; or guarantee the quality, safety, or legality of Pods. All Bookings are made directly between the User and the Pod Organiser — MyDivePod is not a party to those agreements.
Users must be at least 18 years of age, provide accurate and up-to-date information during registration, keep login credentials confidential, and be fully responsible for all activity on their account. Users may not use the Platform for illegal or fraudulent purposes, attempt unauthorized access to other accounts, use automated tools or bots, or circumvent Platform security measures.
MyDivePod makes no representations or warranties regarding the existence, quality, safety, or legality of any Pod; the qualifications or competence of any Pod Organiser or Guide; the condition or safety of any Vessel or equipment; or the accuracy of Pod listings. MyDivePod does not guarantee that Pods will be available as described, operate without interruption, or meet your expectations.
The User fully assumes all risks associated with: participation in diving activities; use of Vessels and equipment; the conduct of Pod Organisers, Guides, and crew; the safety of facilities, equipment, and dive sites; force majeure events including weather, sea conditions, and natural disasters; and any other risks arising from use of the Platform or participation in any Pod.
Diving carries significant health and safety risks including decompression sickness, nitrogen narcosis, oxygen toxicity, barotrauma, hypothermia, cardiac events, and other serious or fatal injuries. The User confirms they do not have any medical condition preventing safe participation in diving (unless disclosed to and approved by the Pod Organiser), are in good physical health, and have obtained any necessary medical clearance before participating.
By using the Platform or participating in any Pod, the User releases MyDivePod and its affiliates from any and all claims arising from use of the Platform, any Booking, diving activities, acts or omissions of Pod Organisers or Guides, or force majeure events. MyDivePod's total liability shall not exceed the amount paid by the User in the 12 months preceding the claim. MyDivePod is not liable for indirect, consequential, punitive, or incidental damages.
All monetary transactions are processed through independent payment processors. MyDivePod holds Deposits in a trust account and applies them towards the total Pod cost. MyDivePod does not provide refunds — refunds are the sole responsibility of the Pod Organiser. Cancellation and modification policies are set by individual Pod Organisers and are displayed before Booking. Users should review each Pod Organiser's cancellation policy carefully before booking.
Users must conduct themselves with respect and professionalism at all times. Prohibited conduct includes harassment, bullying, threats, or intimidation; discrimination based on protected characteristics; posting offensive or defamatory content; attempting to circumvent Platform communication features; organising activities outside the Platform to avoid Deposits or fees; and misrepresenting identity or facts. MyDivePod reserves the right to suspend or terminate accounts that engage in prohibited conduct.
All Platform content — text, images, videos, data, and designs — is the property of MyDivePod or its affiliates. Users are granted a limited, non-exclusive licence to view and use content solely for the purpose of using the Platform. Users may not copy, modify, reproduce, or use content for commercial purposes. Content posted by Users remains their property; they grant MyDivePod a non-exclusive licence to display it on the Platform.
Users agree to indemnify and hold harmless MyDivePod from any claim, loss, cost, or expense arising from their use of the Platform, violation of these Terms, breach of applicable law, or conduct towards other Users or third parties. MyDivePod reserves the right to terminate or suspend any User account at any time, with or without cause and without notice.
Before initiating arbitration, either party may request an informal resolution process with 30 days of good faith negotiation. If unresolved, disputes shall be settled exclusively through binding arbitration under the DIFC Arbitration Rules, seated in Dubai, UAE, conducted in English. You waive the right to participate in any class action or collective proceeding against MyDivePod. These Terms are governed by the laws of the Dubai International Financial Centre (DIFC).
MyDivePod reserves the right to modify these Terms, the Platform, or any features at any time. Continued use following publication of updated Terms constitutes acceptance.
